Terms & Conditions

1. Customer Declaration

By entering into this agreement, you confirm that:

  • You are at least 18 years of age; and
  • You are the legal owner, or an authorised representative of the legal owner, of the property at the installation address; and
  • Your name appears on the property title (or you are duly authorised by the titleholder).

You further confirm that all information provided to Hybrid Solar Solutions Australia is true and accurate.

You authorise Hybrid Solar Solutions Australia to:

  • Submit applications for grid connection on your behalf; and
  • Communicate with the relevant network distributor and associated parties regarding your solar installation.

2. Small-scale Technology Certificates (STCs) and Rebates

Government incentives may apply to eligible solar systems through Small-scale Technology Certificates (STCs).

STCs may be:


You acknowledge and agree that:

  1. You may elect to retain your STCs and manage their sale independently; or
  2. You may assign your STCs to Hybrid Solar Solutions Australia in exchange for a point-of-sale discount.

The owner warrants the retailer that the owner :

  • Traded on the open market (subject to price fluctuations); or
  • Sold through the government clearing house at a fixed price.

  1. has not previously created, or assigned the right to create, any STCs in respect of the Solar  Installation System or any other solar photovoltaic generating unit at the Property; or
  2. will not do anything which would:

i) adversely impact on the performance of the STC Assignments; or

ii) reduce the maximum quantity of STCs that can be created in respect of the Solar Installation System;

  1. has no other existing battery systems installed at the Property, currently or in the past where you have already participated in Federal Government Battery Rebate Scheme

If you choose to assign your STCs:

  • You agree to transfer all STC rights to Hybrid Solar Solutions Australia;
  • The agreed discount reflects the estimated STC value at the time of quotation; and
  • Final system cost may vary based on STC market value at installation.

You remain responsible for payment of any outstanding balance.

3. System Orientation and Performance

You acknowledge that:

  • Optimal solar performance typically requires north-facing panels with minimal shading;
  • Shading, roof orientation, weather, and seasonal variations may significantly impact system performance; and
  • Any performance estimates or savings projections are indicative only and not guaranteed.

Hybrid Solar Solutions Australia will install the system in the most suitable configuration available, taking into account site limitations.

You are responsible for addressing any shading issues & preferences where possible.

4. Roofing Disclaimer

Installations are carried out by appropriately licensed and experienced professionals. While all reasonable care is taken, you acknowledge the following risks:

  • Decromastic Roofs: Installation is generally not recommended. If you proceed, all risks, including minor wear and tear, are borne by you.
  • Asbestos Roofs: Installation is subject to installer availability and undertaken entirely at your risk.
  • Tiled Roofs: Breakage may occur. You must supply replacement tiles on the installation day; otherwise, replacement is your responsibility.
  • Metal/Tin Roofs: Older or corroded roofs may be susceptible to damage, which remains your responsibility.

The Retailer will use all reasonable care during the performance of the Contract in regard to the roof and electrical systems of the Property, the Retailer is not liable for :

  • effects on any roof manufacturer’s warranty
  • damage to the roof or Property which is not due to the Retailer’s breach; or
  • loss or damage to the Owner or a third party arising out of the performance of the Contract in circumstances where there is a breach of the Owner Property Warranties.
  • operational maintenance of the Energy System Installation following Installation Completion.

5. Confidentiality

Your personal information will only be disclosed as necessary to:

  • Process your solar & battery application; and
  • Facilitate STC creation.

Hybrid Solar Solutions Australia does not sell personal data to third parties but may contact you regarding relevant products or services. Please refer to the company’s Privacy Policy for further details.

6. Warranties

Product Warranty

All products are covered by manufacturer warranties.

All electrical parts including but not limited to : Isolators, Cable, Switches, Smart meters are warranted for a 12 months period from installation or in accordance with manufacturers warranty.

Workmanship Warranty

A 12-year workmanship warranty applies to all installations.

We guarantee:

Our workmanship, and the workmanship of our contractors, in installing the System;

the operation and performance of the System, will be free from fault or defect for a period of 5 years commencing on the date the System is installed (Guarantee Period)

we will repair any such fault or defect notified to us within the Guarantee Period, including by replacing all or part of the System where necessary, within a reasonable timeframe at no cost to you.

Conditions:

  • Faults must be reported within the warranty period;
  • Roof leaks must be reported in writing within 6 months of installation.
  • Products supplied under the contract is

This warranty does not apply where:

  • The system has been altered or repaired without approval;
  • Maintenance requirements are not followed;
  • Damage results from extreme weather or external factors
  • Invoice for original system has not been paid in full

7. Payment Terms and Finance

  • Quotes are valid for 7 days unless stated otherwise.
  • A 20% deposit is required to confirm the order.
  • The remaining balance must be paid upon delivery of goods or installation team arrival.
  • Any payment made by credit card will incur a surcharge depending on the card.

Ownership of the system remains with Hybrid Solar Solutions Australia until full payment is received.

In case of non-payment:

  • The company reserves the right to remove installed equipment;
  • The company reserves right to invoice for removal of equipment
  • Any resulting damage will be your responsibility.

In case of Late Payment:

  • The company reserves right to charge late payment fee
  • The company reserves right to charge interest of 18% per annum on outstanding balances & any legal expenses.

Refund Conditions

A full refund will be provided if:

  • Installation is delayed beyond 3 months due to the company;
  • Grid connection is denied; or
  • You decline substitute equipment where original items are unavailable.

Finance

If finance is declined:

  • You remain responsible for full payment;
  • Late payments may incur 18% annual interest;
  • Debt recovery costs will be charged to you;
  • Warranties may be voided in case of non-payment.

IMPORTANT: This Agreement is not regulated by the Commonwealth NCCP Act 2009. As a result: a. If you have a complaint about the Agreement you may not have access to the services of an external dispute resolution scheme that has been approved by ASIC. This means that you may have to go to court to resolve a dispute with the provider b. If you have trouble paying the periodic payments required under this Agreement: i. You may not have the right to ask the provider for a hardship variation to help you get through your financial difficulty. ii. The provider may take action against you for non-payment without giving you an opportunity to remedy the fault. Questions and complaints about the Agreement should be directed to the provider,

8. Premises Access

You grant access to Hybrid Solar Solutions Australia and its representatives at reasonable times to carry out installation and related works.

9. Meter Upgrade

  • Meter/Meter-box/Switchboard upgrades are not included unless specified.
  • You are responsible for ensuring Meter/Meter-box/Switchboard compliance.
  • Any required upgrades or associated costs are the property owner’s responsibility.

The Owner acknowledges that new electricity tariff rates may be applied after the Energy System Installation is carried out. The Owner should contact their electricity retailer to check they are agreeable to the proposed tariff rates before the installation of the system.”

10. Cooling-Off Period

You are entitled to a 10-business-day cooling-off period under Australian Consumer Law.

  • Cancellations must be submitted in writing (email or post) within this period.
  • After this period, the agreement is considered binding.

11. Delivery and Installation

You must:


Variations:

  • Provide site access;
  • Communicate installation preferences before work begins;
  • Sign required documentation on installation day.
  • If we can not fit any panels due to roof space restriction, Screw lines or any objects on the roof, $50 per panel will be discounted from the system price(Net of STC’s).
  • Any agreed design or cost changes will be documented and approved prior to installation.

Additional notes:

  • Temporary power disconnection may be required;
  • 2.4GHZ Wi-Fi connectivity for monitoring is your responsibility;
  • Hybrid Solar Solutions Australia accepts no responsibility for any damage or loss caused to your property by the installer which has not been caused by the installer’s negligence. All Hybrid Solar Solutions Australia installers or subcontractors who are required to have appropriate third party damage insurance, under relevant state and territory laws. Hybrid Solar Solutions Australia will work with you and the installer to rectify any damage caused to your property by the installer’s negligence under property damage warranty of first 6 Months.
  • Non-standard installations may incur additional costs

Where applicable but not limited to :

  • If we find anything which does not allow us to perform work in a compliant manner
  • Any pre existing Meter-box / Switchboard / Wiring issues
  • Any extra safety requirements that may be required to work on roofs due to high pitch or special tiles
  • Any extra cable length which was not accounted for in proposal
  • Any extra visit requires in order to finish the work due to property/owner limitations

12. Time for installation completion

a.  The Owner shall extend the Date for Installation Completion where the Energy System Installation have been delayed in reaching Installation Completion as a result of:

  • i) a breach of the Contract or wilful acts or omissions by the Owner, its personnel or agents (Owner Breach);
  • ii) inclement weather occurring at or around the Property; or
  • iii) delays in stock procurement or other materials beyond the Retailer’s control.

b.  Delays due to an Owner Breach shall entitle the Retailer to reasonable delay costs payable within 10 business days of invoicing.

c.  Installation timelines are estimates only and may change due to external factors (e.g., weather, supply delays, Installers availability).

d.  Hybrid Solar Solutions Australia may terminate this contract with you if either of the following occurs:

  • You do not abide by the terms and conditions.
  • There are delays in the installation due to factors such as weather, Supply, Installers availability, Govt rebate changes, transportation issue results in prices to increase; in these cases full deposit will be refunded or revised quote will be provided.
  • Hybrid Solar Solutions Australia has full authority to cancel the installation if  installation can’t be possible. Customers will receive a full refund of any deposit paid.

13. Risk and Liability

You acknowledge that:

  • STC values and feed-in tariffs are outside the company’s control;
  • System performance and savings are not guaranteed;

You are responsible for:


Hybrid Solar Solutions Australia:

  • Insurance coverage after installation;
  • System maintenance and cleaning;
  • Meter/Meter-box compliance and upgrades.
  • Is not liable for damage to fragile or aged roofing;
  • Accepts responsibility for work performed by its contractors;
  • Recommends using accredited installers for any future system work.

It is customer's responsibility to monitor the system performance on a regular basis and report any doubts or issues to Hybrid Solar Solutions Australia. No compensation is payable for system downtime.

14. Complaint Handling

Complaints should be directed to:

Process:

  • Acknowledgement upon receipt;
  • Response within 14 days;
  • Resolution within 30 days where further investigation is required.

If unresolved, you may escalate your complaint to relevant state consumer protection bodies.
